If you are receiving (or could be eligible to receive) government funds from a disability-based program, you should be especially careful in your estate planning process. The best option for someone in this situation is often a Special Needs Trust.
In the creation of a Special Needs Trust, we will develop a plan to ensure you continue to receive benefits, but also have access to the trust to cover supplemental or special needs. Examples of this could include: specialized therapies, dental care, exercise equipment, computers, etc. Generally, this type of trust will limit the types of distributions the trustee can make so that the distributions will not disqualify the beneficiary from eligibility for government programs.
One of the important questions that needs to be addressed during the creation of a Special Needs Trust is who the Trustee will be. Because of the importance of making proper distributions, the Trustee should be someone who either already knows or is willing and able to learn the requirements of the government programs that provide benefits to beneficiary.
Often, people will name a family member and a financial institution as co-Trustees, because the family member knows the beneficiary and understands his or her special needs and the financial institution has the expertise and knowledge to manage the assets and follow distribution rules.
