A living will, also known as a healthcare power of attorney or an advance directive for health care, is a set of instructions specifying what actions should be taken for your health care and medical treatment in the event that you are no longer able to communicate your preferences directly. The document allows you to name a person whom you trust to make those decisions for you and gives them the information they need in order to do so.

If you do not have a living will, you will receive medical treatment to the fullest extent available for your condition, which means that you could receive more treatment than you desire. Surveys show that up to 95 percent of people would rather refuse aggressive medical treatment than have their lives prolonged in an incompetent or terminal state.

Furthermore, one-third of Americans say they’ve had to make decisions about end-of-life medical care for a loved one and the burden of enduring the poor life quality and prolonged discomfort of a loved one can take its toll on your family in the case that you do not create a living will.

Additionally, if you are over 18 years old and do not have a living will, your doctor may be prohibited by law from discussing your treatment with anyone – even a spouse or parent.

As long as you are able to make decisions for yourself, your living will has no effect. The document is also generally tailored to address terminal illnesses or comatose states in which there is no expectation of recovery and in no way means “do not treat my illness” or “let me suffer.” It allows for medication to be administered for you to be as comfortable as possible and usually addresses situations where you are incurable and medical attention is only prolonging the dying process.
