Guardianships and Conservatorships
Guardianship: A guardian is a person appointed by the Probate Court to make personal decisions for a minor or an incapacitated adult. The Guardian has authorization to make decisions regarding matters such as medical treatment, hospitalization, and residence.
Conservatorship: A conservator is a person appointed by the Probate Court to manage the assets of a minor child or incapacitated adult. The same person can be appointed as both a guardian and conservator, or different people can be appointed for each position.
“Ward” is the title afforded to the minor child or incapacitated adult, and the ward is under protection of the court. Thus, the guardian and conservator must report to the Court.
The guardian is required to ensure that the ward is adequately fed, clothed, sheltered and cared for, and receives all necessary medical attention. Furthermore, the guardian will file a yearly report with the court detailing the condition of the ward and any changes in circumstances or otherwise.
The conservator must file inventory of the ward’s property and a plan for managing, expending and distributing the property on the ward’s behalf. This budget will detail all expenses and the conservator may not spend money other than as detailed in this document without an Order from the Court.
